Direct Licensing Policy

​

SOULiD8 is an independent Australian record label and copyright owner of sound recordings and associated music content created and controlled by Ty Newell, trading as SOUL-I-D8.

​

SOULiD8 has appointed the Phonographic Performance Company of Australia Ltd (PPCA) on a non-exclusive basis to license certain rights relating to the public performance, broadcast and communication of its sound recordings under the terms of the PPCA Input Agreement.

As PPCA's appointment is non-exclusive, SOULiD8 retains the right to directly license its sound recordings and associated rights where appropriate.

Direct Licensing

SOULiD8 may consider requests for direct licences for the use of its sound recordings and music videos where such licensing falls within the rights retained by the copyright owner.

Each request will be assessed individually, taking into account factors including, but not limited to:

• the nature and purpose of the proposed use;

• the type of organisation or applicant;

• the duration of the proposed licence;

• the territory in which the recordings will be used;

• the commercial or non-commercial nature of the proposed use;

• the scope of the rights requested; and

• any other relevant legal or commercial considerations.

The granting of any direct licence is entirely at the sole discretion of SOULiD8.

Where a direct licence is granted, it will generally be subject to:

• a written licence agreement;

• payment of an agreed licence fee (where applicable);

• compliance with any agreed licence conditions; and

• acknowledgement of copyright ownership where appropriate.

SOULiD8 aims to acknowledge licensing enquiries within ten (10) business days. The submission of a licensing enquiry does not imply that a licence will be granted.

This Direct Licensing Policy may be amended or updated from time to time at the discretion of SOULiD8. The most current version of this policy will be made available upon request and, where applicable, published on the official SOULiD8 website.
